These Terms of Service (the "Terms") govern your use of the Vibz mobile applications, website, and related services (collectively the "Service"). By creating a Vibz account or otherwise using the Service, you agree to these Terms.
You must be at least 13 years old to use Vibz, or such greater minimum age required in your country or territory. We determine your country from your phone number at signup and apply the strictest applicable minimum age; if your date of birth is below that minimum, we do not create the account. If you are under 18 (or the age of majority where you live), you confirm that a parent or legal guardian has reviewed these Terms with you and consents to your use of the Service, and certain features of the Service will be disabled or restricted for your account (see our Age & Teen Safety Policy).
If we learn that an account belongs to someone under the minimum age, we will ban the account and delete the associated personal information. We may, at our sole discretion, refuse, suspend, or terminate accounts.
Where teen social access controls are enabled, an eligible minor may link to one adult account after both accounts approve. The adult account must have a declared date of birth indicating age 18 or older and the adult must attest that they are authorized to supervise the minor; this flow is not government-ID or relationship verification. The adult may allow or withhold specific social capabilities for the minor. The link does not let the adult act as the minor, read or decrypt messages, listen to calls, receive communication copies, or monitor activity. Either linked account may revoke the link. Age-restricted content, adult-oriented recommendations, private groups, view-once media, disappearing media, and other age-restricted features remain blocked.
We have a zero-tolerance approach to behavior that endangers our users. You may not, and may not attempt to:
1. Post, transmit, or otherwise share child sexual abuse material (CSAM) or any content that sexualizes minors. Confirmed violations may result in permanent account action and, where reportable, submission to the National Center for Missing & Exploited Children (NCMEC) or disclosure to law enforcement as required by law.
2. Post content that is pornographic, depicts explicit sexual activity, uses nudity for sexual gratification, solicits prostitution or escort services, or offers or requests sexual services or adult content.
3. Threaten, harass, stalk, dox, or incite violence against any person or group.
4. Promote terrorism, violent extremism, or organized criminal activity.
5. Promote suicide, self-harm, or eating disorders.
6. Engage in hate speech based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or serious disease.
7. Sexually exploit, traffic, coerce, or solicit any person, including through DMs, calls, channels, or off-platform payment links.
8. Sell, promote, or facilitate the sale of regulated goods (drugs, weapons, counterfeit goods, stolen goods).
9. Impersonate another person, brand, or Vibz itself; misrepresent your affiliation with anyone.
10. Distribute spam, scams, phishing links, malware, or unsolicited commercial messages; create fake accounts, buy/sell engagement, or use automated tools without our written permission.
11. Infringe anyone's intellectual property, privacy, publicity, or other rights.
12. Reverse-engineer, decompile, scrape, or otherwise interfere with the Service or its security; bypass rate limits, attempt unauthorized access, or use the Service to attack any system.
13. Use the Service in violation of any applicable law.
You also agree to follow our Community Guidelines, which expand on the rules above with examples.
You keep ownership of the content you create on Vibz ("Your Content"). By posting Your Content to the Service you grant Vibz a worldwide (so we can show your content wherever the Service is available), royalty-free (you don't owe us and we don't owe you any payment), non-exclusive (you can use Your Content anywhere else), transferable, sub-licensable license to host, store, reproduce, modify, create derivative works of, communicate, publish, publicly perform and display, and distribute Your Content for the limited purpose of operating, providing, improving, and promoting the Service. This license ends when Your Content is deleted from our systems, except as needed to comply with law, enforce these Terms, or for backup purposes for a limited retention period.
Vibz grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use the Service, subject to and in accordance with these Terms.
You represent that you have all rights necessary to grant the license above and that Your Content does not violate any law or these Terms.
We may remove, restrict, or refuse to publish any content that violates these Terms or our Community Guidelines, or that we believe in good faith may expose Vibz or its users to risk. We are not obligated to host any content.
No access to emergency services. The Service is not a replacement for your ordinary mobile phone or fixed-line telephone. Vibz does not provide access to emergency services or emergency services providers, including the police, fire departments, or hospitals, and does not connect to public safety answering points. Make sure you can contact emergency services through a mobile, fixed-line, or other service.
Vibz may rank and recommend posts, channels, groups, accounts, and other content based on signals such as the channels you follow, likes and comments from other users, how recently content was posted, what you have already seen and how long you watched it, your "not interested" feedback, and whether an account is under 18. Our Recommender & Feed Transparency page explains the current signals in detail.
We may reduce distribution, add warnings, age-gate, or remove content that appears spammy, deceptive, sensitive, unsafe for teens, or likely to violate our rules.
We do not guarantee that any content, channel, author, group, or account will be recommended, ranked, or shown to any particular user.
Our Privacy Policy explains what we collect, how we use it, who we share it with, how long we keep it, and the choices you have. By using the Service you agree to that policy.
To the maximum extent allowed by law, the Service is provided "as is" and "as available" with no warranty of any kind, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent allowed by law, Vibz and its affiliates, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising from or related to your use of the Service. Our total aggregate liability to you for any claim arising from or related to the Service is limited to the greater of (a) the amount you paid Vibz in the 12 months before the event giving rise to the claim, or (b) US$100. Some jurisdictions do not allow these limits — those limits apply only to the extent permitted in your jurisdiction.
You agree to defend and indemnify Vibz from claims arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.
We may change the Service at any time. We may change these Terms by posting an updated version and bumping the version number; we will notify you in-app, and where the changes are material, will require you to accept the new Terms before continuing to use the Service. Continued use after the effective date of an updated version means you accept it.
These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-law principles. Before filing a claim, you agree to try to resolve the dispute informally by contacting legal@marketvibz.com; we will try to resolve it within 60 days. Disputes not resolved informally will be resolved in the state or federal courts located in St. Charles County, Missouri, unless the law where you live entitles you to bring suit elsewhere.
To the extent permitted by law, you and we must initiate any proceeding or action within one (1) year after the dispute first arose; otherwise the claim is permanently barred.
